Loan Disclosures & Terms

All rates and terms are subject to change without notice and will vary depending on the strength of the member’s credit, value of collateral financed and term selected. We offer other rates and terms for members with special borrowing needs. Vehicle loan rates are for purchase of new or used vehicles only and are not available for refinancing existing TVFCU vehicle loans.

Used vehicles are subject to inspection, if applicable.

Proof of insurance is required, with a standard $1,000 deductible.

All applicable fees for the selected loan type are not included in the payment quote and will be added prior to loan signing and fund disbursement.

I authorize Tennessee Valley Federal Credit Union to obtain my credit history. I understand that automatic loan approvals may be issued subject to TVFCU reviewing my employment history and verifying my income. TVFCU may obtain information from others about me and give information to others. I authorize TVFCU to issue any credit devices requested by me. I understand that all funds advanced to me will be subject to the terms and conditions of the loan agreement. You understand that it is a federal crime to willfully and deliberately provide incomplete or incorrect information on loan applications made to federal credit unions or state chartered credit unions insured by the NCUA.

By submitting this application electronically, I agree to the same terms that apply to a signed application. If there is a co-applicant on this loan, that co-applicant has authorized the submission of this application. This electronic submission qualifies as my signature. I understand that I/we will have to sign loan documents before funds can be disbursed. Alimony, child support or separate maintenance income need not be included if you do not wish to have it considered as a basis for repaying this obligation.

If this proposal is accepted, all applicable fees will be added prior to signing and fund disbursement, but Payment Protection is included in the proposed payment above. Please click on the corresponding link(s) above if you would like to recalculate your proposed loan payment without Payment Protection.

Not all products and services described in our Website are available in all geographic areas, and the terms of certain products and services may vary from geographic area to area.  You may not qualify for certain products and services, and we reserve the right to determine eligibility for any product or service.  Products and services described, as well as fees, charges, terms and conditions relating to such products and services, are subject to change without notice.  No information on our Website is intended as a legal offer or solicitation for the purchase of any security or financial instrument, product or service, and all products and services are subject to our eligibility and application requirements. No Credit Union company is acting as an advisor or fiduciary in publishing any information on our Website. The Website is not intended to provide legal, tax, investment, or insurance advice. YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF OUR WEBSITE IS AT YOUR SOLE RISK. THE WEBSITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.  WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

WE MAKE NO REPRESENTATION OR WARRANTY THAT (I) THE WEBSITE WILL MEET YOUR REQUIREMENTS, (II) THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE INFORMATION THAT MAY BE OBTAINED FROM THE USE OF THE WEBSITE WILL BE ACCURATE, TIMELY, COMPLETE, ADEQUATE OR RELIABLE, (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE WEBSITE WILL MEET YOUR EXPECTATIONS, AND/OR (V) ANY ERRORS WILL BE CORRECTED.  ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE WEBSITE IS OBTAINED AT YOUR OWN DISCRETION AND RISK, AND WE ARE NOT RESPONSIBLE FOR ANY DAMAGE TO YOUR EQUIPMENT OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL, WHETHER DUE TO ANY VIRUS OR OTHERWISE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM US OR THROUGH OR FROM THE WEBSITE WILL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

YOU AGREE THAT WE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY HARMS, INJURIES, CLAIMS, OR DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, RESULTING FROM (I) THE USE OF OR THE INABILITY TO USE THE WEBSITE, (II) THE COST OF OBTAINING SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY PRODUCTS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED, OR MESSAGES RECEIVED, OR TRANSACTIONS ENTERED INTO, THROUGH OR FROM THE WEBSITE, (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, (IV) STATEMENTS OR CONDUCT OF ANY OTHER PERSON USING OR ACCESSING OUR WEBSITE, (V) ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, VIRUS OR LINE OR SYSTEM FAILURE, AND/OR (VI) ANY OTHER MATTER RELATING TO THE WEBSITE OR YOUR USE THEREOF.

IF YOU LIVE IN A JURISDICTION THAT DOES NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SOME OR ALL OF THESE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.

EXCEPT WHEN CAUSED BY OUR INTENTIONAL MISCONDUCT OR WANTONNESS, YOU AGREE TO INDEMNIFY, PROTECT AND FULLY COMPENSATE US, OUR SERVICE PROVIDERS, AND OUR LICENSORS FROM ANY AND ALL THIRD-PARTY CLAIMS, LIABILITY, DAMAGES, EXPENSES AND COSTS (INCLUDING, BUT NOT LIMITED TO, REASONABLE ATTORNEYS FEES) CAUSED BY OR ARISING FROM YOUR USE OF THE WEBSITE, YOUR VIOLATION OF THIS AGREEMENT OR YOUR INFRINGEMENT OF ANY INTELLECTUAL PROPERTY OR OTHER RIGHT OF ANY PERSON OR ENTITY.

This Agreement constitutes the current, sole and entire agreement between you and us with respect to the use of our Website, and any and all prior terms of use with respect to the use of our Website are superseded by this Agreement.  You acknowledge and agree that no practice or course of dealing between you and any Credit Union company, nor any oral representations by any Credit Union representative, which vary the terms and conditions of this Agreement shall constitute a modification or amendment of the terms and conditions of this Agreement.  No failure by us to exercise, and no delay by us in exercising, any right or remedy shall operate as a waiver thereof.  If any provision of this Agreement or the application thereof to any person or circumstances shall, to any extent, be invalid or unenforceable, such provision shall be deemed automatically reformed to the extent, and only to the extent, necessary to render it valid and enforceable under applicable law; however, if such reformation of the provision is not reasonably possible, the provision shall be deemed severed from this Agreement with respect to the person or circumstances as to which such provision shall be invalid or unenforceable, and the remainder of this Agreement shall continue in full force and effect to the fullest extent permitted by law.  This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflicts of laws provisions or your actual state or country of residence, and applicable federal law. For purposes of any action, suit, or proceeding arising out of this Agreement, you expressly submit to the jurisdiction of all federal and state courts located in the State of Tennessee, and agree that we, in our discretion, may require that Tennessee, be the venue for any legal proceedings arising out of or related to this Agreement.  You waive and agree not to assert in any action, suit or proceeding that you are not personally subject to the jurisdiction of such courts, that the action, suit or proceeding is brought in an inconvenient forum or that venue of the action, suit or proceeding is improper.  In the event that you should have any claim or cause of action against us arising out of your use of the Website, you agree that, regardless of any statute or law to the contrary, such claim or cause of action must be initiated or filed in a court of competent jurisdiction within one (1) year after accruing or be forever barred. If you have agreed to per your Member Agreement or any other Agreements with the Credit Union, then the Arbitration provisions shall govern in place of any statements here above.

Cookies

Cookies are small text files that your browser stores on your computer or mobile device when you visit a site. When you return to a site you have visited before, your browser gives this data back to the site to help it remember your preferences and personalize your experience; enhance site performance and security; and enable interest-based advertising. When you visit our Site, we, or our service providers, may use cookies or other similar technologies to collect information on our Site.

How we use cookies: We use cookies and information collected through their use to make your experience with The Credit Union and certain other sites richer and more personalized based on the products, services, or other interactions you have with us and other sites. Information collected through use of cookies may be used to make offers to you via online ads, email, U.S. mail, or telephone, subject to the privacy preferences you have on file with The Credit Union. (Privacy preferences for employer-sponsored retirement accounts default to no marketing, solicitation, or sharing for marketing purposes without specific consent.) We use cookies, sometimes in conjunction with service providers, in online advertising either on our own Site or on third party sites to help determine which of our advertisements are most likely to appeal to you. We also use cookies for purposes such as maintaining continuity during an online session, collecting data about the use of our Site, monitoring online promotions, and anti-fraud and information security purposes.

Other parties that may collect information about your web browsing behavior when you use our Site are generally limited to service providers who may only use any information collected to provide services and marketing for us and not to provide services or advertising for any other party. Note, however, that we also provide certain links on our sites that allow you to interact with third parties who offer additional features, such as allowing web surfers to share information on another platform, such as a social media platform. At other times, information from a third party may be embedded on our Site, such as a map. These features often function through the use of third-party cookies utilized by the third-party site, such as a social media platform. As a result, if you use any of these features, these third parties may be able to access information about your web browsing on the pages of our Site where links to these features are in place. You may wish to review information at third party sites, such as social media platforms where you have an account, to determine how these third parties treat data that they obtain with the use of cookies.

If you choose not to accept cookies, you may experience some reduction in functionality depending on which Site you are using. You also may need to accept cookies in order to maintain certain online advertising opt-out elections (see “Use of Information for Advertising; Online Behavioral Advertising” section below).

Types of cookies we use:

There are two types of cookies, session and persistent.

Session cookies expire at the end of a web browsing session when you close your browser. They help the site remember your actions during the current website visit.

Persistent cookies remain stored on your device between browsing sessions until a pre-set expiration period determined by us or our service providers. These types of cookies allow us to improve website experiences and place advertisements.

There are four categories of cookies we may use on our Site:

Strictly necessary: These cookies are necessary for our site to function or to enable functionality requested by you. They’re needed to do things like securely signing on to our site, applying for a product or service, or honoring a language preference. You can set your browser to block all cookies, but some parts of our site won’t work without them.

Functional: These cookies enable an enhanced or personalized experience. They may be set by us or third-party providers whose services we have available on our site. This may include things like playing videos on our site or downloading PDF forms or seeing content personalized to you. If these cookies are blocked, then some of these services may not function.

Performance and analytical: These cookies allow us to monitor the performance of our website, such as how many people are visiting our site and how they got there, so we can measure and improve your experience on our site. If these are blocked, we have less information available to us to continue to improve our site.

Marketing and advertising: These cookies may be set by us or through our advertising partners. This information is used to understand your use of our site so we may show you more relevant online content and advertising. If you block or turn them off, you may still see online advertisements, but they won’t be tailored to you based on your browsing behavior.

You can manage cookies: Managing cookies is domain and browser specific. For example, you may manage our use of certain types of cookies on the tvfcu.com domain or by using an industry accepted opt-out preference signal such as the Global Privacy Control (see more details below). Your preference applies to this domain and the browser you are currently using. It does not apply to different browsers or other Credit Union managed domains. If you visit this domain using a different browser or delete your browser cookies, you will need to exercise your preference again.

Global Privacy Control (GPC) is a service that lets you opt out of sharing information for targeted advertising on nonaffiliated websites, applications, or services. You can enable this service through specific browsers or browser extensions (see which browsers are GPC-enabled at the Global Privacy Control website https://globalprivacycontrol.org/ ). Once you activate the GPC setting, your browser will automatically send participating websites (like ours) a “do not sell or share my personal information” signal.

Industry standards are currently evolving, and we may not separately respond to or take any action with respect to a “do not track” configuration set in your internet browser.

Additional options to manage cookies: If you receive an ad delivered on a third-party site in part based on information collected through the use of cookies, you may opt out of receiving such ads by visiting the Network Advertising Initiative’s Consumer Opt-Out link (https://optout.networkadvertising.org/?c=1 ) or the Digital Advertising Alliance’s Consumer Opt-Out link (https://optout.aboutads.info/?c=2&lang=EN) and learn how to opt-out of receiving interest-based advertising from companies that participate in those programs. This opt-out works via cookies set on a particular browser, so if you delete cookies from your browser, or use a different browser or device, you will need to opt out again.

For mobile devices, you can turn off personal ads on iOS devices (https://support.apple.com/en-us/105131 ) or opt out of ads personalization on Android devices ( https://support.google.com/googleplay/answer/3405269/ ).

Use of Information for Advertising; Online Behavioral Advertising We may use personal information in connection with our online advertising activity. Online advertisements may be in the form of banner ads, splash ads, or other formats. These advertisements may appear on our Sites, and we may contract with third party advertising companies to promote our products and services and serve related advertisements on websites and mobile applications that are owned or operated by parties not affiliated with us.

In order to better understand which of our products and services may be of interest to you and to tell you about those products and services, we may from time to time collect information about your online activities over time and across third party websites and online services. We also may engage third party service providers to collect information about your online activities over time and across third party websites and online services when you use our Site. Serving advertisements based on a person’s online activities over time and across third party websites and online services is generally known as “online behavioral advertising.” Here are some tips and other important information regarding online behavioral advertising:

  • If you are given an opportunity to opt out from online behavioral advertising and you make an opt-out election, then in order to maintain the opt-out election at our Sites and at other websites that might serve behavioral advertisements on our behalf, your browser must be enabled to accept cookies. If you delete cookies, buy a new device, access our Sites or other websites from a different device, login under a different screen name, or change web browsers, you will need to opt out again.
  • You also may be able to avoid online behavioral advertising by disabling scripting in your browser. Please check the security settings in your browser to determine the status of scripting settings. However, please note that if you disable scripting, you may be unable to use certain features on a website. In other cases, the website may become inoperable, your experience may not be optimal, you may not be using the latest standards for safe and secure transactions, or you may not be allowed to access the site.
  • Some browsers may provide a “do not track” or similar setting. Our Sites do not respond to such settings. If you enable such a setting it will not prevent the collection of information about your online activities over time and across third party websites when you visit our Sites.
  • You should be aware that even if you exercise a choice not to receive targeted advertisements in connection with online behavioral advertising, your election does not necessarily stop the collection of information about your online activities over time and across third party websites and online services for purposes other than online behavioral advertising.
  • You may still receive generic advertising (i.e., advertising that is not based on your online activities over time and across third party websites and online services) even if you opt out of online behavioral advertising, and opting out of online behavioral advertising may not result in the termination of advertising and promotions provided in connection with rewards programs we may offer.

We may share personal information with third-party advertising companies with which we have contracted in order to support other targeted advertising, promotional, and rewards programs that we offer.  You may opt out of rewards programs we offer and the targeted advertising and promotions that are associated with the programs.  Please see the terms of the applicable rewards program for information about opting out.

Social Media We may from time to time use social media websites and applications (e.g., Facebook®, Twitter®, YouTube® and LinkedIn®) to interact with you and to communicate information about us and about our products and services. We may collect information from our interactions with you at such social media websites and applications, and we may use the information for the purposes and uses described in this Notice. If we disclose any terms of use at specific social media pages that we manage, you also will be subject to those terms when you interact with those pages. The owners and operators of social media websites and applications may impose their own terms of use and privacy policies with respect to the use of their websites and applications. This Notice does not govern the use, handling, and treatment of content you may post at social media websites and applications by the owners and operators of those websites and applications. You should review the terms of use and privacy policies of any social media website or application that you use to make sure you understand your rights and obligations with regard to content that you post.
